TERMS AND CONDITIONS.
ARTICLE 1: OBJECT.
The purpose of these General Conditions of Sale is to define the terms and conditions under which MONSIEUR LOUTRE offers and sells its Products to its customers.
MONSIEUR LOUTRE reserves the right to adapt or modify these General Conditions of Sale at any time.
All modifications of these general conditions of sale are effective from the moment they are put online.
Article 1.1: Capacity.
The Internet user and / or the Customer declares to have the capacity to enter into this Contract, that is to say to have the legal majority and not to be under tutorship or guardianship.
Article 1.2: Destination.
The Customer declares not to make purchases of Monsieur Loutre products and articles with a view to reselling them.
To ensure the availability of our products to all of our customers, particularly during promotional offers, MONSIEUR LOUTRE reserves the right to refuse to honor all or part of an order deemed abnormal, in particular, at with regard to the quantities of products usually ordered by a consumer.
ARTICLE 2 - ACCEPTANCE OF CONDITIONS.
The customer acknowledges having read, at the time of placing the Order, these general conditions of sale and expressly declares to accept them without reservation.
These general conditions of sale govern the contractual relations between MONSIEUR LOUTRE and his client, both parties accepting them without reservation.
ARTICLE 3 - CONFIDENTIALITY.
All personal data is treated confidentially and your rights to protect your legitimate concerns are strictly observed in accordance with legal requirements.
The collection of personal data of the Internet user is necessary in order to:
- process his order and deliver it (marital status, surname, first name, postal address)
- inform him about the status of his order (phone number, email address)
- inform him of the latest trends and promotional offers from Monsieur Loutre (phone number, email address)
We guarantee our customers that we do not communicate any personal data.
ARTICLE 4 - PRODUCTS.
Most of the products offered by MONSIEUR LOUTRE to its customers are immediately available.
However, all the products marketed by MONSIEUR LOUTRE may or may not necessarily be sold online.
Article 4.1: Availability.
In the event of temporary unavailability, MONSIEUR LOUTRE undertakes within 7 days from the validation of the order, and after agreement of the Customer:
either to deliver the ordered product to the Internet user,
or to reimburse it.
In all cases, MONSIEUR LOUTRE undertakes to warn any Internet user who has ordered an unavailable item. In the event of a definitive shortage of stocks on one of the products or items of the order, the order placed will lapse without compensation on either side.
The customer will then be contacted and will have the option of either:
To be reimbursed
To re-order without the item out of stock.
ARTICLE 5 - ORDER.
The automatic registration systems are considered as proof of the nature, content and date of the order.
MONSIEUR LOUTRE will confirm to the customer the acceptance of his order by sending a confirmation message to the email address that the latter will have communicated. The sale will not be concluded until the sending of the said order confirmation.
MONSIEUR LOUTRE reserves the right to refuse or cancel any order from a customer, in particular in the event of the insolvency of said customer or in the event of a default in payment of the order concerned or of a previous delivery or a dispute relating to the payment of a previous order.
The mentions indicated by the customer, when entering the information inherent to his Order, bind the latter. Monsieur Loutre cannot be held responsible for errors made by the customer in the wording of the contact details of the recipient of the order (delivery address, billing address in particular) and for delays in delivery or the inability to deliver the Products ordered that these errors could cause.
ARTICLE 6 - PAYMENT.
The price invoiced to the customer is the price indicated on the Order confirmation sent by MONSIEUR LOUTRE.
The price of the Products is payable in cash by one of the means of payment offered on the site on the day of the actual order.
You can pay for the products by credit card (CB, Visa, Mastercard) or by PayPal.
The maximum amount you can spend on an order depends on the payment method you select and whether you are a registered user or guest.
The order validated by the customer will only be considered effective when the secure banking payment center has given its agreement on the transaction and, where applicable, after acceptance of the assumption of the risk by the insurer.
Article 6.1: Secure payment.
When the Internet user pays by credit card, he is invited at the end of the order to indicate his card number, the validity date and the last three digits appearing on the back of the card. Various accesses to authorization distributors are then made in order to verify the data to avoid abuse and fraud. For this, the server is in encrypted mode and all the information conveyed is encrypted. None of this data travels unencrypted over the Internet.
In all cases, the online supply of his card number and the final validation of his order will constitute proof of the integrity of the order and of the exigibility of the sums due in execution of the said order.
This validation constitutes express acceptance of all operations carried out on the Site.
ARTICLE 7 - DELIVERY.
After confirmation of the Order and subject to full payment of the price of the products ordered, MONSIEUR LOUTRE undertakes to ship the products ordered to his customer at the delivery address within (3) days for orders placed on Monday. to Friday within the limits of available stocks.
All the Products stipulated in the Orders placed with MONSIEUR LOUTRE are intended for the personal use of customers or recipients whose name is mentioned at the delivery address.
Where applicable, the customer undertakes to pay upon receipt all taxes, duties, taxes and other charges, present and future, due in respect of the delivery of said products themselves; the joint and several liability of MONSIEUR LOUTRE cannot at any time be engaged in this respect.
Customers or recipients of the Products are prohibited from any partial or total resale of the Products.
Delivery will be made by Colissimo or by Mondial Relay.
Any order placed on Friday after 12 noon will be processed from Monday of the following week. Likewise, any order placed on a public holiday will be processed the following working day.
In the event of a delivery delay exceeding seven (7) days, the Customer may, if he wishes, and except in cases of force majeure, terminate the sales contract by registered letter with acknowledgment of receipt. This right must however be exercised within sixty (60) working days from the delivery date initially provided for in the contract.
In the event that one or more of the Products ordered is missing or damaged, the customer or the recipient must make any reservations with the carrier within 24 hours of delivery, at the time of delivery.
In the event of apparent defects, the customer benefits from the right of return under the conditions provided.
For reasons of availability of the Products ordered, an Order may be the subject of several successive deliveries to the customer.
In the event that the customer would like the Products ordered to be delivered to two separate addresses, the latter should place 2 separate Orders.
All orders are processed within 48 hours from Monday to Friday (excluding public holidays) subject to payment validation. Packages are generally shipped within 2 days of receipt of payment. They are shipped via Colissimo or Mondial Relay with a tracking number and delivered without signature.
Shipping costs include preparation and packaging costs as well as postage. Preparation costs are fixed, while transport costs vary according to the total weight of the package. We recommend that you consolidate all of your items into one order. We cannot combine two orders placed separately and shipping charges apply to each of them. Your package is shipped at your own risk, but special attention is paid to fragile items.
The dimensions of the boxes are appropriate and your items are properly protected.
ARTICLE 8 - RETURNS AND REFUNDS.
The customer has 14 days from the invoice date, without undue delay, to return the products to us as well as the standard withdrawal form (return slip).
SHIRTS: in accordance with Article L221-28 of the Consumer Code, no right of withdrawal can be exercised by the customer from the date of registration of the order, this one relating to goods made to measure according to customer specifications. No return or refund can therefore be made on this basis. Any alterations to be made remain the responsibility of the customer as well as the return costs.
Sale items, socks worn are neither returned nor exchanged.
Return costs are the responsibility of the buyer.
If you are unable to print the return slip, please write all the information requested on the back of the invoice.

In the event of exercise of the right of withdrawal, MONSIEUR LOUTRE undertakes to reimburse the sums paid by the customer, free of charge, with the exception of return costs.
The reimbursement is due within a maximum period of 15 days.
MONSIEUR LOUTRE does not offer an exchange service. You can of course return a product which does not satisfy you fully and for which a refund will be granted. If you want another product, color or size, please place a new order.
Once the products you have returned have been checked and inspected in our warehouse, you will receive a refund notification by email if a refund is granted to you.
To do this, pack it or the items to be returned in the original packaging, including the invoice for the order and the return slip in the package.
Then send everything to the above address by Colissimo (For reasons of speed).
Your refund will be paid to the card or account you used to place the order as soon as possible.
Typically, refunds appear on your statement after 2 to 15 business days. This period depends solely on the practices of your card issuer. You can always check the status of your refund on your account online or by contacting your card issuer.
In order to obtain a full refund, it is important that we receive returned products in the condition in which you received them: returned products must be complete, not worn or washed, and all of their labels must be intact.
ARTICLE 9 - PRICE.
The price is expressed in euros. The price indicated on the Product Sheets does not include the costs inherent in transport.
The price indicated in the Order confirmation is the final price expressed inclusive of all taxes and including VAT. This price includes the price of the Products, the costs of handling, packaging and conservation of the Products, the costs of transport and commissioning.
MONSIEUR LOUTRE reserves the right to modify the prices at any time but undertakes to apply the prices in force at the time of the validation of the order by the Customer.
If one or more taxes were to be created or modified up or down, this change may be reflected in the selling prices of products and sales documents.
ARTICLE 10 - PROMOTIONAL OFFER.
MONSIEUR LOUTRE promotional offers (promotional codes) are limited to one per customer and per order. It is not possible to combine promotional codes.
If you have a promotional code, indicate it on the cart page, in the Promotional code field, and click Apply. Please check the expiration date of your promotional code before using it. NB: you cannot use more than one promotional code for the same purchase. Please note: if you use promotional codes for sale products, the promotional code may not be applicable. Each promotional code is valid for one use only, unless otherwise agreed.
ARTICLE 11 - RESPONSIBILITY.
MONSIEUR LOUTRE cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, which could result from improper use of the Products sold.
In the event of difficulties in the application of this contract, the customer and Mr. Loutre reserve the right, before any legal action, to seek an amicable solution.
Failing this, any legal action shall be brought before the competent courts of the domicile of the defendant or of the place of delivery or of the jurisdiction of the registered office of MONSIEUR LOUTRE.
ARTICLE 12 - GUARANTEE.
In all cases MONSIEUR LOUTRE cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in a receiving country other than FRANCE.

ARTICLES 13 - LEGAL INFORMATION.
The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. In accordance with the "Informatique et Libertés" law, the processing of personal information relating to customers has been declared to the National Commission for Computing and Liberties (CNIL).
ARTICLE 14 - SPECIAL CONDITIONS.
In the event of non-availability of the Products ordered, an Order may not be the subject of several successive deliveries to the customer, this in derogation of the penultimate paragraph of ARTICLE 7.
ARTICLE 15 - INTELLECTUAL PROPERTY.
MONSIEUR LOUTRE owns the rights to the texts, images, whether or not animated, general architecture, graphics and therefore all of the content of the Site.
In accordance with Article L122-4 of the Intellectual Property Code, any representation or reproduction, in whole or in part, of the content made, by any means whatsoever, without the consent of MONSIEUR LOUTRE is illegal. The same is true for adaptation or transformation, translation, arrangement or reproduction by any art or process.
Violation of the provisions of Article L122-4 of the Intellectual Property Code constitutes an infringement within the meaning of Article L335-2 of the same code, which constitutes an offense.
Nothing in these General Conditions of Sale and Use may be interpreted as granting the Internet user a right of any kind whatsoever over the elements protected by intellectual property, of which MONSIEUR LOUTRE may have the property or the exclusive right. operating.

ARTICLE 16 - ENTIRE CONTRACT.
These General Conditions of Sale concluded between MONSIEUR LOUTRE and the Internet user express all the rights and obligations of the parties.
No document, no indication, no correspondence can give rise to obligations under these General Conditions of Sale, if they are not the subject of an amendment signed by both parties.
If a particular provision of these General Conditions of Sale is held to be invalid or declared as such by a decision having the force of res judicata of a competent court or if one of the clauses of these Conditions is null and void by a change of legislation, regulations, the other stipulations will retain all their force and scope.
This can in no way affect the validity and compliance with these General Conditions of Sale.
